Norway is a member of The International Union for the Protection of New Varieties of Plants (UPOV) and the Norwegian authority that grants plant breeders’ rights is the Plant Variety Board. We can guide you safely through the application process
The exclusive right to a plant variety (PBR) can be commercially exploited by the breeder
The exclusive right to a plant variety (PBR) can be commercially exploited by the breeder allowing others to produce and sell propagation material for the variety upon payment of a license fee or a royalty fee. Legal protection of your plant variety also means that you get the exclusive right to the name of the variety, preventing, for example, use and registration of the variety name as a trademark for the relevant plant.
Provided that an annual fee is paid, plant breeder's rights can be maintained for up to 20 years. For shrubs and trees, the protection duration is 25 years.
